Frequently Asked Questions
Here are some answers to commonly asked questions about the service provided by The Will Registry.
|
Q: What are the benefits of registering my Will with The Will Registry?
A: The location of your last Will and any of your legal documents which you have registered are found on one secure, easy to use database. "The Will Registry" is a name which is easy to recall and the website is easy to navigate and is user friendly.
Having the location of your Will and legal documents registered allows you the peace of mind that your loved ones will be able to locate your Will and carry out your last wishes.
|
Q: Can I register other documents with The Will Registry?
A: Yes you can. Depending on the Option you select, you may register additional legal documents (eg Enduring Powers of Attorney, Lease Documentation, Trust Deeds, Company Registers, Advanced Health Directives and Insurance Policies). You may register any document which is important to you.
|
Q: Why is registering the location of my Will so important?
A: Your Will is possibly the most important document that you will sign in your life time. It deals with how you wish to distribute property and assets that you have accumulated over your lifetime. The Executor of your estate must carry out your wishes. Also in the event of leaving young children upon your death, your wishes as to guardianship are also contained in your Will.
If your Will cannot be located, it defeats the purpose of having a Will. Many solicitors can confirm that there are cases where the wishes of the deceased are not carried out because the last Will was unable to be found. This is becoming more common these days with more people living and working overseas.
|
Q: What if I do not have a Will?
A: We strongly recommend that you seek legal professional assistance with a view to having a Will prepared and signed at your earliest convenience. Your local solicitor will be able to assist you or alternatively you can call the Law Society in your area. See the USEFUL LINKS page on this website for further direction.
|
Q: How do I find out where a Will is located?
A: By conducting a search at SEARCH on this website. You will need the full name of the person for whose Will you are searching. A search fee will be charged.
|
Q: Does The Will Registry hold my Will or legal documents?
A: No, The Will Registry does not hold any documents. You only register the location and date of the Will with the Registry. This service is purely an information service and not a document storage facility.
|
Q: What information is needed to Register my Will and/or other legal documents with The Will Registry?
A: We would require certain personal details to identify you from others who may share the same name as you. Your full name, address and date of birth will be required.
If your Will is held by a firm of solicitors, then provide the name of the firm, the address, and if possible, the name of the solicitor who serviced you and his/her contact details. The more details provided will make it easier for your survivors in locating your Will and other legal documents.
However, if you have placed your Will elsewhere, (eg in a safety deposit box, with a professional or family friend), please provide as much detail as possible to help your survivors.
